Each volunteer must RSVP to be permitted entry through the volunteer gate on festival day.
No exceptions will be made. We appreciate your understanding to ensure the safety of our guests, volunteers, and staff by listing the names of all volunteers attending with you.
All volunteers must consent to our waiver by checking the box below. Therefore anyone who has not registered cannot participate in the festival. Any unlisted individuals will be subject to an approval process and paperwork before entering as a volunteer on festival day.
In consideration of my voluntary participation in the Activities (the “Activities”) provided by the Hart Square Foundation, Inc. (“Hart Square” or “Hart Square Village”) at the Event, I, for myself, my personal representatives, heirs, successors, and assigns, hereby enter into this Acknowledgment of Risk and Waiver of Liability Form (the “Agreement”) and agree as follows:
1. ACKNOWLEDGMENT OF RISK. Hart Square Foundation provides a wide range of activities at its community events. These activities require the Participants to engage in various activities such as dancing, cooking, sewing, carving, pottery, and the use of hand tools, among others. The Activities in which I will be participating involve risk of harm or injury including, but not limited to, cuts, scrapes, itching, hives, dermatitis, burns, lacerations, fractures, sprains, severed digits, or death. Additionally, if the Activity involves the preparation of food or food products, there is a possibility that I may develop gastroenteritis or other related foodborne illnesses. I hereby acknowledge and assume all responsibilities and risks of physical harm and/or injury (including death) that may result from my participation in the Activities. I understand that it is, and will be at all times during the Event, my sole responsibility to cease my engagement in any Activities if I have sustained any harm and/or injury or if I am not in the proper mental or physical condition to continue my participation.
I acknowledge that the Activities at the Event are conducted for historical and educational purposes only and Hart Square is not responsible for any replication of the Activities I may conduct outside the grounds of Hart Square Foundation and direct supervision of the Foundation’s staff.
2. ASSUMPTION OF RISK AND WAIVER OF LIABILITY. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself, illness, damage, loss, claim, liability, or expense of any kind that I may experience or incur in connection with my attendance at the Hart Square Foundation or any Activity or participation in Hart Square events. I accept and acknowledge the entire responsibility and liability for any injuries, including death, or any other damages to or destruction of my property, sustained, or alleged to have been sustained in connection with or arising out of Hart Square, the Activities, or the Events.
To the fullest extent allowed by law, I agree and covenant not to sue, pursue any action, or seek any remedy against Hart Square, its employees, owners, officers, directors, members, managers, independent contractors, and/or representatives now and in the future and I do now and will in future release Hart Square’s employees, owners, officers, directors, members, managers, independent contractors, agents, and/or representatives against any and all claims, causes of action (including, among all others, those based on an allegation of negligence, etc.), liabilities, damages, attorney’s fees, costs, and/or expenses of every nature and type arising out of or related to my participation in the Activities or Events.
3. MISCELLANEOUS PROVISIONS. I agree that: (a) this Agreement will be governed by applicable North Carolina laws, without applying conflict of laws principles; (b) this Agreement will supersede and replace any prior agreements covering the same subject matter; (c) this Agreement shall remain in full force and effect in the future unless and/or until specifically replaced by another written agreement approved by the Foundation and signed by Participant/Parent; (d) no amendment or waiver of this Agreement shall be effective unless and/or until it is in writing specifying such amendment or waiver and is approved and signed by the Foundation and by Participant/Parent; and (e) should any terms/provisions of these Agreements be declared invalid, I agree that the remaining terms/provisions of these Agreements shall remain valid and operative.
